Frankster Terms of Service

Overview
Welcome to Frankster — Australia's home of premium men's shorts. These Terms of Service ("Terms") set out the rules that apply when you visit frankster.com.au (the "Site") or buy from us. By using the Site or placing an order, you agree to these Terms.
We're a small, independent Australian business founded in 2023, based at 480 St Kilda Road, Melbourne. We sell directly to customers in Australia and a small number of international markets (currently the USA, UK, Canada, New Zealand, Singapore, the European Union and other countries via our "Rest of World" shipping option).
Where you live affects some of these Terms — particularly shipping costs, return policies and your consumer rights. We've called out the differences clearly throughout the document. If anything isn't clear, get in touch at hello@frankster.com.au.
These Terms apply to all users of the Site, including browsers, customers, and anyone interacting with us. If you don't agree to these Terms, please don't use the Site.
Our store is hosted on Shopify, which provides the e-commerce platform that powers Frankster.
1. Who can use Frankster
You must be at least 18 years old to place an order on Frankster. By agreeing to these Terms, you confirm that you are 18 or over.
You may not use our products for any illegal or unauthorised purpose, or use the Site in any way that violates applicable laws (including copyright laws). You must not transmit viruses, malicious code, or anything destructive through the Site.
A breach of these Terms may result in us suspending or terminating your access to our services.
2. General conditions
We reserve the right to refuse service to anyone for any reason, within the limits of applicable law.
Your interactions with the Site (other than payment information) may be transferred unencrypted over various networks and may be adapted to meet technical requirements. Payment information is always encrypted in transit.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any part of the Site, our content or services without our written permission.
The headings in this document are for convenience only and don't affect interpretation.
3. Prices and currency
Prices on the Site are displayed in the currency of the market you're shopping in:
- Australia: Australian Dollars (AUD), inclusive of GST
- USA: US Dollars (USD)
- UK: British Pounds (GBP)
- EU: Euros (EUR)
- New Zealand: New Zealand Dollars (NZD)
- Canada: Canadian Dollars (CAD)
- Singapore: Singapore Dollars (SGD)
- Other countries: as displayed at checkout
Prices are subject to change without notice. We may modify, suspend or discontinue any product or service at any time without liability to you or any third party.
4. Shipping
For Australian customers
Free standard shipping on all orders within Australia. No minimum order required.
Delivery typically takes 3–7 business days, depending on your location. Express shipping is available at checkout for a fee.
For international customers
We ship to the USA, UK, Canada, New Zealand, Singapore, the EU and selected other countries.
Free shipping applies to orders above a market-specific minimum order value, as displayed at checkout. Orders below the threshold are charged a shipping fee calculated based on destination. Shipping fees and minimum order values may change at our discretion and will always be displayed at checkout before you complete your order.
Delivery times vary by destination and shipping method, typically 5–15 business days from dispatch.
Duties, taxes and customs (international orders only)
International orders are shipped on a Delivered Duty Paid (DDP) basis. This means any applicable import duties, taxes, customs fees, or brokerage charges are calculated and collected at checkout, shown as a separate line in your order total, and remitted by us to the destination country.
You won't be asked to pay additional duties, taxes, or customs charges when your parcel is delivered — what you see at checkout is the final price, with no surprises at the door.
In rare cases, your local customs authority may apply additional charges that fall outside the duties and taxes we collect at checkout (for example, brokerage fees specific to certain carriers or regions). Where this happens, those additional charges remain your responsibility. We aim to minimise these by working with carriers that include brokerage in our shipping arrangements.
Promotional shipping conditions
During promotional periods (such as Black Friday or end-of-season sales), free shipping may require a minimum order value, even for Australian customers. Any such conditions will be clearly displayed at checkout.
5. Returns and exchanges
We want you to love your Frankster shorts. If something isn't right, here's how returns work.
For Australian customers
Free 100-day returns and exchanges. If you change your mind, you have 100 days from delivery to return or exchange your purchase. We cover the return shipping.
Conditions:
- Items must be unworn, unwashed, with original tags attached
- You must submit your return through our Returns Portal at frankster.com.au/pages/returns-portal. Items sent back without going through the portal won't be processed and can't be refunded
- You're entitled to one free exchange per order. If an item is exchanged and then returned or exchanged again, you'll cover the return shipping
- For orders that are exchanged and then returned in full, a $25 processing fee will be deducted from your refund to partially cover the cost of pick & pack, shipping and inspection — twice
- Items purchased with a large promotional discount (such as a $30 review code) can be returned, but you'll need to pay for the return shipping label
For international customers
You can return or exchange items within 100 days of delivery. The same product conditions apply (unworn, unwashed, with tags, submitted via the Returns Portal), but international customers are responsible for the cost of return shipping, including any duties, taxes, or fees on the return leg.
For international exchanges, you cover the cost of returning the original item; we'll cover the cost of shipping the replacement back to you (one exchange per order).
We strongly recommend using a tracked shipping service for returns, as we can't be responsible for items lost in transit.
Faulty or incorrect items (all customers, worldwide)
If you receive an item that's faulty, damaged, or not what you ordered, contact us within 30 days of delivery at hello@frankster.com.au. We'll cover the cost of return shipping and provide a replacement or full refund. This applies to all customers regardless of where you live and does not affect your statutory consumer rights (see Section 6).
Return shipping label expiry
When we issue you a return shipping label, you must send the items back within 30 days of receiving the label. Returns sent after this period may be rejected or subject to additional fees.
Excluded products
Some products can't be returned for hygiene reasons. This includes drinkware items such as water bottles and tumblers. If these were provided as a "gift with purchase" and the main order is later returned, the full retail value of the gift item will be deducted from the refund.
Promotional return conditions
During promotional periods (such as Black Friday or end-of-season sales), a return shipping fee may apply to Australian returns and will be deducted from the refund. Any such conditions will be clearly communicated on the Site during the promotion.
6. Your statutory consumer rights
Nothing in these Terms excludes or limits any consumer rights you have under the laws of your country of residence. Where our voluntary policies (like our 100-day return window) give you more than the law requires, our voluntary policies apply. Where the law gives you more than our policies, the law applies.
In particular:
- Australian customers have rights under the Australian Consumer Law (ACL), including consumer guarantees that products will be of acceptable quality, fit for purpose, and match their description
- EU customers have a statutory right of withdrawal within 14 days of receipt of goods under the Consumer Rights Directive (2011/83/EU)
- UK customers have a right to cancel within 14 days under the Consumer Contracts Regulations 2013, plus rights under the Consumer Rights Act 2015
- US, Canadian, New Zealand, Singaporean and other customers have the consumer protection rights provided by their local laws
For international customers exercising statutory withdrawal rights (rather than our voluntary 100-day return policy), you remain responsible for the cost of return shipping unless the items are faulty or incorrect.
7. Products
Our products are described and shown as accurately as possible on the Site. However:
- We've done our best to display colours accurately, but your screen may render colours differently — we can't guarantee that what you see on your device exactly matches the physical product
- We may limit the sales of any product to any person, region or jurisdiction at our discretion
- We reserve the right to limit quantities of any product or service
- Product descriptions and pricing are subject to change without notice
- Any product offer is void where prohibited
If a product doesn't meet your expectations, your statutory rights apply (see Section 6) and we'll do our best to make it right.
8. Billing and account information
We reserve the right to refuse or cancel any order at our discretion. We may limit or cancel quantities purchased per person, per household, or per order. This may include orders placed by the same customer account, the same payment card, or the same billing/shipping address.
If we change or cancel an order, we'll try to notify you using the contact details you provided. We may limit or prohibit orders that appear to be placed by dealers, resellers, or distributors.
You agree to provide accurate, complete and current purchase and account information, and to keep your details up to date.
9. Discount codes and promotions
From time to time we run promotions and offer discount codes. Unless we say otherwise at the time:
- Some discount codes may require you to cover shipping costs. This will be displayed at checkout and in the code's terms
- Discount codes are typically not combinable with other offers
- We reserve the right to cancel or modify promotions at any time
- Promotions may have specific terms (such as minimum order values, eligible products, or expiry dates) which will be communicated at the time
10. Personal information and privacy
Our handling of your personal information is governed by our Privacy Policy. By using the Site, you agree to the collection and use of your information as described there.
When you visit our Site, we use cookies and similar tracking technologies. Visitors from certain regions (including the EU, UK, and California) will see a cookie consent banner where you can manage your preferences.
11. Reviews, comments and user-generated content
If you submit reviews, photos, comments, or other content to the Site or to our social media channels:
- You confirm that the content is your own and doesn't violate anyone else's rights (including copyright, trademark, or privacy rights)
- You grant us a non-exclusive, royalty-free, worldwide licence to use, edit, publish, distribute, and adapt the content in connection with our business — including in marketing and advertising
- We may (but aren't obliged to) monitor or remove content that's unlawful, offensive, threatening, defamatory, obscene, or otherwise objectionable
You are solely responsible for the content you submit. We take no responsibility for content posted by users or third parties.
12. Third-party tools and links
The Site may include third-party tools or link to third-party websites. We don't control or endorse these, and we provide them on an "as is" basis without warranty. You use them at your own risk and should review the relevant third-party's terms and privacy practices before engaging with them.
We're not liable for any harm or damages related to your use of third-party tools, websites, or services accessed via the Site.
13. Errors, inaccuracies and omissions
Occasionally there may be errors, inaccuracies or omissions on the Site — including in product descriptions, pricing, promotions, shipping charges, transit times, or availability. We reserve the right to correct any errors and to change or update information, or cancel orders, if any information on the Site is inaccurate at any time (including after you've submitted your order). If we cancel an order due to an error, we'll refund any payment made.
14. Prohibited uses
You may not use the Site or its content:
(a) for any unlawful purpose (b) to solicit others to perform unlawful acts (c) to violate any international, federal, state, provincial or local laws or regulations (d) to infringe our or others' intellectual property rights (e) to harass, abuse, harm, defame, slander, intimidate, or discriminate against anyone (f) to submit false or misleading information (g) to upload or transmit viruses or malicious code (h) to collect or track the personal information of others (i) to spam, phish, pharm, pretext, spider, crawl, or scrape (j) for any obscene or immoral purpose (k) to interfere with or circumvent the security of the Site or any related website
We may terminate your access to the Site for any of these violations.
15. Disclaimer of warranties and limitation of liability
We don't guarantee that your use of the Site will be uninterrupted, timely, secure, or error-free, or that the results from using the Site will be accurate or reliable.
The Site and the products and services delivered through it are provided "as is" and "as available," without warranties of any kind, except as expressly stated by us or required by applicable consumer law (which we don't seek to exclude).
To the maximum extent permitted by law, Frankster Pty Ltd, its directors, employees, contractors, suppliers and service providers are not liable for any direct, indirect, incidental, punitive, special, or consequential damages — including lost profits, lost revenue, loss of data, or replacement costs — arising from your use of the Site or any product purchased through it.
This limitation does not apply to any liability that cannot be excluded under applicable consumer law (such as the Australian Consumer Law).
16. Force majeure
We're not liable for any failure or delay in performing our obligations under these Terms caused by events outside our reasonable control — including natural disasters, pandemics, acts of government, strikes, supplier failures, shipping carrier disruptions, or major IT or telecommunications failures. If such an event occurs, we'll let you know and do what we reasonably can to minimise the impact.
17. Indemnification
You agree to indemnify and hold harmless Frankster Pty Ltd, its directors, employees, contractors, and service providers from any claim or demand (including reasonable legal fees) arising from your breach of these Terms or your violation of any law or third-party right.
18. Severability
If any provision of these Terms is held to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the unenforceable portion will be severed from the rest of the Terms — which will continue to apply.
19. Termination
These Terms remain in effect until terminated by either you or us. You may terminate them at any time by stopping using the Site. We may terminate them at any time if we believe you've breached any provision.
Obligations and liabilities that arose before termination will survive.
20. Entire agreement
These Terms, together with any policies posted on the Site (including our Privacy Policy and Returns Policy), constitute the entire agreement between you and us regarding your use of the Site. Any ambiguity will not be construed against us.
21. Governing law
These Terms are governed by and interpreted in accordance with the laws of Australia, except where mandatory consumer protection laws in your country of residence apply. Where those mandatory laws apply, they will prevail to the extent of any inconsistency.
Disputes between Frankster and consumers may be resolved through the consumer protection mechanisms available in the consumer's country of residence.
22. Changes to these Terms
We may update these Terms from time to time. The current version is always available on the Site, with the "Last updated" date at the top. Your continued use of the Site or our services after we post an update constitutes acceptance of the changes, to the extent permitted by law.
